Before using the Mail & Guardian Online Blog (Amagama) service (“the Service”), please read the following as it sets out your rights and obligations in respect of the Service.

By using, accessing or viewing the Service you agree to be bound by the following terms and conditions:

1. Service

1.1 M&G offers the Service at its discretion.

1.2 M&G may interrupt, remove or change the Service, or stop your access to the Service at any time at its discretion without notice to you.

1.3 M&G does not warrant or represent that the Service will be free of errors or interruptions.

1.4 Without limiting 1.1 to 1.3 inclusive, M&G shall use its best endeavours to ensure that the Service is available at all times.

2. Use of the Service

2.1 You may only use the Service if you are at least twelve years old and you do not suffer from any mental impairment that may cause you to be potentially vulnerable to abuse by using the Service.

2.2 You shall not use the Service:

2.2.1 in a way that is harmful, obscene, defamatory, illegal, constitutes hate speech or incitement to violence, or constitutes an infringement of copyright or other intellectual property rights; or

2.2.2 for the purpose of advertising or marketing any business, product or service.

2.3 M&G does not monitor or moderate the Service and accordingly has no knowledge of the content on the Service and does not condone, approve, endorse or support any content provided on the Service. However, should M&G in its discretion be of the opinion that you are contravening the provisions of 2.2 or any of these terms and conditions, M&G shall be entitled, without notice to you, to remove the offending content or stop your access to the Service.

2.4 You hereby indemnify M&G against any loss or damage, howsoever arising, that you or any third party may suffer as a result of your use of the Service or your provision of content to the Service.

3. Copyright.
You may freely:

* copy, distribute and display any content on the Service;
* make derivatives of such content;
* make commercial use of such content,

provided that you clearly credit the original author of the content and quote the Service as the source of the content.

4. Limitation of liability.

4.1 You use the Service at your own risk.

4.2 M&G will not be liable to you or any third party for any loss or damage, howsoever arising, from your use of the Service.

5. Change of terms and conditions

5.1 M&G may change these terms and conditions at any time without notice to you.

5.2 By using the Service, you will become bound to the then current version of these terms and conditions ("current version") and, unless stated otherwise in the current version, all previous versions will be superseded by the current version.

5.3 You will be responsible for reviewing the then current version each time you use the Service.

5.4 Without derogating from the aforegoing, and without imposing any obligation on M&G whatsoever, M&G reserves the right to give you notification of changes to the relevant terms and conditions either by posting a notice on the Service. On notification of the existence of the changed terms and conditions, you will be obliged to visit the legal section of the Service and view the current version.

5.5 A certificate signed by M&G (or by one of M&G's directors, whose appointment, qualification and authority need not be proved) will be prima facie proof of the date of publication and content of the current version and all previous versions of the terms and conditions.

5.6 In these terms and conditions:

5.6.1 “M&G” means to On the Shelf Trading 44 (Pty) Ltd trading as Daily Mail & Guardian and Mail & Guardian Online; and

5.6.2 “use” includes (without limitation) providing content to the Service.

5.7 These terms and conditions will be interpreted, and any matter arising from your use of the Service will be adjudicated in terms of the laws of the Republic of South Africa.
